A Word about Buyer Agency

For the Exclusive Buyer Brokerage Agreement, State law prohibits a Broker from representing a Buyer as a client without first entering into a written agreement with Buyer under O.C.G.A. § 10-6A-1 et seq. A written and signed "buyer agency" agreement is required by Georgia law to be represented by a Buyer's Agency. Buyer agency is the highest level of client representation afforded to a buyer by a real estate professional, who is required to represent your interests as long as those interests are not illegal. The Seller of a property is represented by the listing agent and the client is represented by their buyers' agent. In negotiating price and terms, the seller has an advocate to represent their interests, but, unless you the "buyer" have executed a buyers' agency agreement with your agent, your interests may not be represented.
